Using Litigation as a Legal Strategy Tool when the System Fails

The speakers will highlight the importance of incorporating litigation into practitioners’ immigration practice as a tool to advance the rights of unaccompanied immigrant children. The panel will discuss the different types of litigation claims available to practitioners; how practitioners can identify and document patterns of injustice, which could be elevated to litigators; and, once litigation action has commenced, the role that an immigration attorney can play in the process. The panel will discuss successful examples, including Garcia Ramirez v. ICE, ImmDef v. DHS, and other issues ripe for litigation.
