SIJS-Based Deferred Action Policy Updates

The information in this blog post is current as of Wednesday, April 15, 2026.

There have many developments impacting youth with Special Immigrant Juvenile Status (SIJS) in the past year. In June 2025, the U.S. Citizenship and Immigration Services (USCIS) announced rescission of its deferred action policy for SIJS youth, and litigation resulted in a November 2025 order to stay the rescission of and reinstate the policy. The court then issued an opinion in January 2026 clarifying that the November order does not require USCIS to “treat SIJ status as a ‘strong factor that weighs heavily in favor of granting deferred action,’” except for those whose I-360 petitions were approved after April 6, 2025 and before June 6, 2025. Plaintiffs filed an appeal in February 2026 specifically challenging the standard set forth for youth with petitions approved on or after June 6, 2025, arguing inconsistency with the court’s order staying USCIS’s rescission of SIJS-based deferred action. On April 10, 2026, USCIS issued Policy Memorandum (PM)-602-0198, “Special Immigrant Juvenile Classification and Deferred Action” rescinding SIJS-based deferred action again. This post provides further information on the background of SIJS-based deferred action and the rescission of the policy and details the resulting litigation and related updates.

As of publication of this blog post, the November court order provided that Special Immigrant Juveniles with petitions approved between April 6, 2025 and June 6, 2025 are entitled to deferred action adjudications consistent with the 2024 USCIS Policy Manual guidance. The court later clarified that USCIS is not required to consider approval of SIJS as a strong factor in consideration of deferred action for those with petitions approved after June 6, 2025. USCIS’s recently issued PM-602-0198 (April 10, 2026) provides a 30-day notice of USCIS’s renewed policy terminating SIJS-based deferred action, which will again eliminate automatic consideration of deferred action upon approval of the I-360. Those with I-360 petitions received by May 10, 2026 will benefit from USCIS’s 2022 deferred action policy.
