Updated Resources: The Unaccompanied [non-immigrant] Child (UAC) Designation

We have heard from many of you that the procedural path forward for your asylum seeking clients has been unclear over the past year because of the inconsistent guidelines from DHS and EOIR, and while federal litigation about USCIS policy remains pending.  In response to your requests, CILA has updated two of its resources, Flow Chart: Finding the Path Forward for Your Asylum Seeking Client (UAC Determinations) and Overview of the UAC Designation.  They can be found on our Additional Resources page.  If you need the password, please email cila@abacila.org.

The resources are best used together.   The Flow Chart is a decision tree designed to help guide you and your client through several different scenarios. The Overview provides the history and impact of law and policies regarding the UAC determination (up through publishing- August 13, 2020).  This area of law is dynamic; be sure to check for any policy or litigation changes (after 8/13/20) before advising your client on their options.
